Under the Health Insurance Portability and Accountability Act (HIPAA), we must ensure that your medical records remain confidential. This document serves as a guide to how we manage your information and the specific rights you have over that data. We are bound by the terms of this notice as long as it is in effect. If our privacy protocols change, we will update this document and make it available at our Tampa clinic.
2. Defining Your Protected Information
Your Protected Health Information (PHI) includes any detail that links your identity to your healthcare. This covers your name, address, and contact details in conjunction with your clinical history, laboratory findings, and payment records. Our duty is to protect this data across all mediums, whether it is stored in our digital infrastructure, written in physical files, or discussed among our clinical team.
3. Routine Data Handling for Clinic Functions
We are permitted to use and share your PHI for three primary internal functions: treating you, securing payment, and managing our daily practice.
- Facilitating Your Medical Care: Our team reviews your health history to provide appropriate clinical guidance. This may involve sharing your file with external specialists or diagnostic facilities to coordinate a cohesive care plan. By providing us with your information, you allow our providers to consult with other medical professionals involved in your direct care.
- Managing Financial Transactions: We utilize your PHI to process billing and secure reimbursement for our services. This includes transmitting necessary details to your health insurance provider to verify your coverage or obtain approval for specific procedures. If you opt to pay for a service personally and in full, you may request that we do not disclose those specific details to your insurance carrier.
- Internal Administrative Tasks: We use your records to maintain the high standards of our Tampa practice. This involves quality assessments, internal audits, and staff training. These administrative tasks allow Vitality Medical & Longevity Center to improve its operations and ensure every patient receives professional, accurate service.
4. Legal Exceptions for Information Sharing
There are specific instances where federal or Florida laws require us to disclose your information without a signed release.
- Assisting Law Enforcement and Public Safety: We may provide PHI to law enforcement agencies in response to a court-issued warrant or to assist in the search for a person of interest, such as a missing individual or a fugitive. Additionally, if a crime is committed within the physical premises of our Tampa clinic, we are permitted to report that event and any relevant information to the proper authorities to ensure the safety of our staff and patients.
- Oversight of Public Health and Safety: We report data to state and federal agencies to track the spread of diseases or to prevent injury. We also comply with Florida workers’ compensation regulations, sharing necessary data to facilitate the processing of work-related injury claims. If we believe a patient poses a serious and immediate risk to themselves or the public, we may disclose limited information to prevent harm.
5. Your Right to a Ledger of Data Transfers (The Disclosure Inventory)
You have the right to request a comprehensive history of the instances where we have shared your PHI with outside parties. This “Disclosure Inventory” does not include routine sharing for clinical care, billing, or internal practice management.
When you ask for this history, our Tampa administrative team will compile a report showing who received your data, the date it was sent, and the reason for the transfer. We track these events for a six-year period. Your first request in any 12-month window is free of charge, though we may apply a processing fee for additional requests within the same year. We will respond to your inquiry within 60 days of receiving your written request.
6. Customizing Your Contact Protocols (Private Reach-Out Preferences)
We recognize that you may have specific preferences for how we contact you. You have the right to establish alternative contact arrangements to ensure your medical matters remain private.
For example, you may request that our office only calls you at a specific work number rather than your home phone, or you may ask that we send all written mail to a designated P.O. Box instead of your residential address. You do not need to provide a reason for this request. Our staff will honor all reasonable instructions regarding these contact methods. To set these preferences, please provide a written instruction to our patient coordinator in Tampa.
7. Accessing and Updating Your Medical History
You have the right to review and obtain a physical or digital copy of the records we maintain regarding your care. Under Florida law, we must provide these within 30 days of your request. While we charge a small fee to cover the labor and materials involved in duplicating these files, we ensure the process is straightforward for our patients.
If you believe a part of your record is inaccurate, you may submit a formal request for an amendment. We will review the file and, if we agree with the change, update the record. If we find the original record to be accurate, we will provide a written explanation for our refusal and allow you to submit a statement of disagreement to be kept in your permanent file.
8. Notification of Data Events
Vitality Medical & Longevity Center utilizes encrypted storage and strict access controls. However, if an event occurs that compromises the security of your unencrypted data, we will follow the notification protocols required by federal law and the Florida Information Protection Act. You will be informed of the nature of the event and the steps we are taking to safeguard your information moving forward.
9. Protecting Sensitive Records Under Florida Law
Florida provides additional safeguards for specific types of medical data. We do not release information concerning HIV status, mental health evaluations, or substance abuse treatment without a high-level, specific authorization from the patient, except where the law strictly mandates disclosure for public safety.
10. Directing Questions or Complaints
If you have concerns about our privacy practices or feel your data has not been handled correctly, you may file a complaint with our Privacy Officer. We take these matters seriously and will conduct a thorough internal review of our Tampa office’s protocols. You also have the right to notify the Secretary of the U.S. Department of Health and Human Services. Vitality Medical & Longevity Center maintains a zero-tolerance policy for retaliation; you will not be treated differently for raising a concern.
